REGISTRY WATCH® is a service provided by BUFETE HERNANDEZ MUSSIO Y ASOCIADOS®. It consists of constant surveillance of your property, vehicle or boat, recorded in the National Registry, to make sure that there are no fraudulent transfers or liens on the property. Periodical reports are sent to the client via email or fax. In case detection of a fraud, litigation fees are covered by BUFETE HERNANDEZ MUSSIO Y ASOCIADOS ® as part of the REGISTRY WATCH service.

Background
Property fraud has become a real threat to owners of property in Costa Rica. Many have resorted to different techniques in order to avoid the losing of their property due to fraud. A Notary Public has public faith, and whatever he submits to the Registry is presumed to be true, according to the law. But some Notaries have committed fraud, or have been deceived by the parties who appear before them through the use of fake identity cards or passports. Therefore, a real need exists for a service that provides a constant watch on property movements at the Registry, and early detection is crucial in avoiding greater damage when a fraud is committed.

Criminal organizations which include unscrupulous notaries have been detected, and the media has helped to expose the real dimensions of the problem.

In the year 2005 its main offices were established in Jaco, in the Central Pacific, but the law firm has a network of legal professionals in different provinces around the country, including Heredia, Alajuela, Guanacaste and San Jose. Definition of property fraud
If the property is transferred or encumbered, REGISTRY WATCH will communicate with the owner. If the transfer or encumbrance is fraudulent, REGISTRY WATCH will cover legal fees of litigation to regain property ownership and/or remove encumbrances.

Lately, another technique used by crooks has been detected, consisting of fraudulently changing the president or legal representative of a corporation that owns real estate. Once the change is recorded in the Registry, the property is transferred or encumbered illegally by the criminals.

Membership Costs
A client may protect up to three properties, whether real estate or vehicles, or any combination thereof, by paying a yearly membership fee of $344. This price covers the monthly reports, based on regular checks on the status of the property according to the National Registry records, as well as the legal fees involved in defending the ownership of the property in case of a fraudulent transfer or lien.

Additional properties may be included for a yearly fee of $248 per property, and the monthly reports always include corporations that may be involved in the ownership.
